This course will discuss the basics of bankruptcy:

  • the different types of bankruptcy
  • what assets are exempt or excluded in the bankruptcy process
  • which types of debts may not discharge and why
  • how bankruptcy may be an effective turn around strategy.

Additionally, the course will discuss:

  • What kinds of taxes may be discharged by a bankruptcy filing;
  • The rules that render certain taxes dischargeable in bankruptcy;
  • Tolling events that affect the rules of tax discharge;
  • How taxes are treated under chapter 7, 11 and 13 of the Bankruptcy Code;
  • Litigating tax issues in bankruptcy court;
  • Recent changes in BAPCPA related to discharge of taxes.

The overall objective is for you to come away with a basic understanding of:

  1. The United States Bankruptcy laws; and
  2. How certain taxes are discharged through the bankruptcy process.
