Benjamin Franklin said ". . . in this world nothing is certain but death and taxes." He was half right: certain taxes may be discharged in bankruptcy. This class will examine, in detail, the how, what and when of eliminating certain tax obligations through the bankruptcy process. Attendees will learn:

  • What kinds of taxes may be discharged by a bankruptcy filing;
  • The rules that render certain taxes dischargeable in bankruptcy;
  • Tolling events that affect the rules of tax discharge;
  • How taxes are treated under chapter 7, 11 and 13 of the Bankruptcy Code;
  • Litigating tax issues in bankruptcy court;
  • How tax liens are dealt with in bankruptcy;
  • Recent changes in BAPCPA related to discharge of taxes.

The interaction between the offer-in-compromise process and bankruptcy will be discussed. A detailed discussion of the timing of a bankruptcy filing as related to prior bankruptcy filings, offers in compromises and other tolling events affecting discharge of tax in bankruptcy will also be analyzed.
